By accessing or using MarrakechSouks.com (the "Website," "we," "us," "our," or the "Operator") — including by submitting an inquiry, making a booking, or making a payment — you ("User," "you") agree to these Terms of Use ("Terms"). If you do not agree, do not use the Website or Services.

The Website is operated by a duly organized and registered private limited liability company. Full corporate registration details are on file with our payment processor(s) and are available to competent regulatory authorities and to any user upon a verified, lawful request submitted via the contact details in Section 20.

1. Purpose of the Website

MarrakechSouks.com provides travel-related information, destination content, and coordination of private Marrakech souk tours and shopping experiences ("Experiences"), and may in the future offer the sale of Moroccan crafts and related goods ("Products") through the Website.

The Website is intended for informational, booking, and communication purposes.

2. Bookings, Pricing & Payment
  • Prices for Experiences and Products are displayed in the currency shown at checkout and may change at any time before a booking is confirmed and paid for.

  • A booking is only confirmed once payment has been processed and you receive a written confirmation (email or WhatsApp) from us.

  • Submitting an inquiry does not guarantee availability, pricing, or confirmation.

  • Payments are processed by Stripe, Inc. and/or other payment processors we may add. We do not store your full payment card details. See our Privacy Policy for details.

  • You are responsible for ensuring your payment method is valid and sufficiently funded. Failed or disputed payments may result in cancellation of a booking.

3. Cancellations & Refunds
  • Unless a specific Experience or Product listing states otherwise:

    • Cancellations made more than 72 hours before the scheduled Experience are eligible for a full refund, less any non-recoverable third-party costs already incurred (e.g., prepaid guide, transport, or venue fees).

    • Cancellations made within 72 hours of the scheduled Experience, or no-shows, are non-refundable.

    • We may, at our discretion, offer rescheduling instead of a refund.

  • Refunds, where due, are issued to the original payment method and may take up to 14 business days to appear, depending on your bank or card issuer.

  • For future Product sales: unless stated otherwise on the product listing, returns/refunds for physical goods will be subject to a separate Returns Policy to be published at the time e-commerce functionality launches, and will comply with applicable consumer protection law in the buyer's jurisdiction where legally required (e.g., EU 14-day withdrawal right for online purchases, where applicable).

4. No Guarantee of Availability

Availability, schedules, pricing, transportation, accommodations, activities, and related information may change at any time without notice. Submitting an inquiry or request does not guarantee confirmation, acceptance, or availability.

5. Independent Third-Party Providers

Certain Experiences involve independent third parties — including local guides, drivers, artisans, riads, restaurants, and vendors — who are not employees or agents of the Operator.

The Operator does not guarantee, and is not responsible for, the conduct, licensing, legality, availability, pricing, quality, or safety practices of any independent third-party provider. Your relationship with such providers, where a direct transaction occurs, is between you and them.

6. Informational Nature of Content

Content on the Website is provided for general informational purposes only. While we make reasonable efforts to keep information accurate, we do not guarantee its accuracy, completeness, reliability, availability, timeliness, or suitability for your purposes. You are responsible for independently verifying any travel-critical information (visa/entry requirements, health requirements, safety advisories, etc.) with official sources before travel.

7. Eligibility & Age

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to make a booking or payment on this Website. Minors may participate in Experiences only when accompanied by a booking adult who accepts full responsibility for them.

8. User Responsibilities

You agree not to:

  • Use the Website for any unlawful purpose

  • Submit false, fraudulent, or misleading information (including for bookings or payments)

  • Attempt unauthorized access to any part of the Website or its systems

  • Disrupt or interfere with the Website's operation

  • Introduce viruses, malware, or other harmful code

  • Abuse, harass, or spam our communication channels

  • Conduct automated scraping, crawling, or data extraction without prior written permission

We reserve the right to refuse service, cancel a booking, or restrict access for violation of these Terms.

9. Intellectual Property

Unless otherwise stated, all Website content — including text, branding, logos, graphics, photographs, layout, design, and structure — is protected by applicable intellectual property laws and is owned by or licensed to the Operator. Unauthorized copying, reproduction, or redistribution is prohibited without prior written authorization.

10. User-Submitted Content

If you submit reviews, photos, or other content to us (e.g., for testimonials), you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content for marketing and operational purposes, unless you tell us otherwise in writing. You confirm you have the right to submit any content you provide.

11. Communications

Communications conducted through email, WhatsApp, or online forms may not always be fully secure or instantaneous. Do not send sensitive information (e.g., full payment card numbers, passport scans) through unsecured channels unless specifically requested through a secure process.

12. No Professional Advice

Information on the Website does not constitute legal, immigration, tax, medical, insurance, or professional travel advice. Consult an appropriate licensed professional for such matters.

13. Travel Insurance

We strongly recommend that all Users obtain comprehensive travel insurance covering trip cancellation, medical emergencies, and personal belongings before traveling. The Operator is not responsible for costs arising from the absence of adequate travel insurance.

14. Limitation of Liability

To the maximum extent permitted by applicable law, the Operator shall not be liable for:

  • Indirect, incidental, or consequential damages

  • Delays or travel disruptions

  • Transportation issues

  • Acts or omissions of independent third-party providers

  • Government restrictions or actions

  • Technical interruptions or Website unavailability

  • Data loss

  • Inaccuracies in Website content

Where liability cannot be excluded under applicable law (including mandatory consumer protection law), our liability is limited to the maximum extent such law permits, and in any case shall not exceed the amount you paid for the specific Experience or Product giving rise to the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by our proven negligence, fraud, or any other liability that cannot lawfully be excluded.

15. Force Majeure

The Operator is not responsible for failures or delays caused by circumstances beyond its reasonable control, including natural disasters, government actions, border restrictions, strikes, telecommunications failures, transportation disruptions, or public health emergencies.

16. External Platforms

The Website may integrate or reference third-party platforms, including WhatsApp, Google services, maps, social media, and embedded media. We are not responsible for the content, availability, or practices of these external platforms.

17. Website Availability

Access to the Website may be interrupted, suspended, modified, or discontinued at any time, with or without notice.

18. Indemnification

You agree to indemnify and hold the Operator harmless from claims, damages, or liabilities arising from your misuse of the Website, violation of these Terms, violation of applicable law, or content you submit — except to the extent such claims arise from our own negligence or breach of these Terms.

19. Governing Law & Disputes

These Terms are governed by the laws of the Kingdom of Morocco, as the jurisdiction in which the Experiences are physically delivered, without regard to conflict-of-law principles — except where mandatory consumer protection laws of your country of residence (for example, EU/UK/US consumer protection rules) grant you rights that cannot be waived by contract, in which case those mandatory protections continue to apply alongside these Terms.

Any dispute arising from these Terms or your use of the Website shall first be attempted to be resolved informally by contacting us at the email in Section 20. If unresolved, disputes shall be subject to the competent courts of Morocco, without prejudice to any mandatory right you may have to bring proceedings in your own country of residence under applicable consumer protection law.
